CONTEST RULES AND REGULATIONS

Open to residents of Canada (excluding Quebec)


  1. NO PURCHASE IS NECESSARY. By entering this Contest (defined below), entrants agree to abide by these contest rules and regulations (the “Official Rules”). The decisions of the Sponsor (defined below) with respect to all aspects of the Contest are final. The Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram or Twitter.  You understand that you are providing your information to the Sponsor and not to Instagram or Twitter. The information you provide will be used to administer the Contest in accordance with the Sponsor’s privacy policy. Instagram and Twitter are completely released of all liability by each entrant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not Instagram or Twitter.
  2. SPONSOR & CONTEST PERIOD: The Temporary Captain Contest (the “Contest”) is sponsored by Hotels.com LP (the "Sponsor"). The Contest commences at 12:00:00 AM Eastern Time (“ET”) on July 4, 2017 and will end at 11:59:59 PM ET on July 24, 2017 (the "Contest Period"). All times in these Official Rules are Eastern Times.
  3. LIGIBILITY: To enter the Contest and be eligible to win a Prize (see rule 8), a person (“Entrant”) must at the time of entry, be a legal resident of Canada (excluding Quebec) who has reached the age of majority in the province/territory in which he/she resides. Specifically excluded from entering the Contest are: (i) employees, shareholders, officers, directors, agents, representatives, and advertising and promotional agencies of the Sponsor (the “Contest Parties”), and each of their respective subsidiaries and affiliates; and (ii) a member of any such person’s immediate family (regardless of where they live) or persons with whom they are domiciled (whether related to the person or not). In these Official Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters, partner or spouse.
  4. HOW TO CREATE A VIDEO: To participate in the Contest, you must first visit tempcaptain.com (the “Contest Website”) where you can view example videos and view the script (the “Script”). Next, follow the instructions to create your own video (the “Video”) to enter into the Contest (see rule 5). The Video must be of yourself auditioning as Captain Obvious by following the Script and completing the last segment with why you would make a great temporary Captain Obvious while also showcasing your personality.
  5. HOW TO ENTER: No Purchase is Necessary. There are three (3) methods of entry (collectively referred to as a “Method of Entry”) into the Contest and they are as follows:
    1. Contest Website: To enter the Contest through the Contest Website, visit tempcaptain.com and complete the entry form by first uploading your Video (see rule 4) and entering your full name and a valid email address and confirm compliance with these Official Rules. Next, indicate if you wish to receive future information from the Sponsor (optional). Upon doing so, click “Submit” and your Video will be reviewed by the Sponsor (or its designated representative(s)) to determine if the Video meets the requirements outlined in rule 7. If determined to be eligible, at Sponsor’s sole discretion, your Video will be considered an official entry (the “Website Entry”) into the judging process (see rule 9).
    2. TWITTER: To enter the Contest through Twitter, tweet your Video (see rule 4) during the Contest Period with the hashtag #tempcaptain (the “Twitter Hashtag”) on Twitter from your Twitter account. Upon doing so, your Video will be reviewed by the Sponsor (or its designated representative(s)) to determine if the Video meets the requirements outlined in rule 7. If determined to be eligible, at Sponsor’s sole discretion, your Video will be considered an official entry (the “Twitter Entry”) into the judging process (see rule 9). A person may only tweet a Video once and re-tweets will not be accepted. Entrants are subject to Twitter's Terms of Service and Rules; these can be found at https://twitter.com/tos. Sponsor is not responsible in any way for any decisions Twitter makes regarding the Entrant's account with Twitter.

      Multiple, separate tweets contributed to the Twitter Hashtag and/or any re-tweets of an entrant’s tweet will not increase the chances of winning. Anyone found to use multiple accounts to enter the Contest will be ineligible. Anyone found “spamming” by posting multiple unrelated updates or comments that are unrelated to the Contest discussion will be disqualified.

    3. INSTAGRAM: To enter the Contest through Instagram, post your Video (See rule 4) during the Contest Period, with the hashtag #tempcaptain (the “Instagram Hashtag”) on Instagram from your Instagram account. Upon doing so, your Video will be reviewed by the Sponsor (or its designated representative(s)) to determine if the Video meets the requirements outlined in rule 7. If determined to be eligible, at Sponsor’s sole discretion, your Video will be considered an official entry (the “Instagram Entry”) into the judging process (see rule 9). Entrants are subject to Instagram’s Terms of Service and Rules; these can be found at https://help.instagram.com/478745558852511. Sponsor is not responsible in any way for any decisions Instagram makes regarding the Entrant's account with Instagram.

      Multiple, separate posts contributed to the Instagram Hashtag will not increase the chances of winning. Anyone found to use multiple accounts to enter the Contest will be ineligible. Anyone found “spamming” by posting multiple unrelated updates or comments that are unrelated to the Contest discussion will be disqualified.

  6. ENTRIES: The Website Entry, Twitter Entry, and Instagram Entry will herein each be called an Entry and collectively referred to as Entries. Please note, all posts submitted as an Entry must be set to public. There is a limit of one (1) Entry per person per Method of Entry (See rule 5) during the Contest Period however each Entry must be unique. You may only use one (1) Instgram account, one (1) Twitter Account and one (1) email address to enter the Contest. Anyone found “spamming” by posting multiple unrelated updates or comments or by sending large numbers of duplicates with the Hashtag will be disqualified. Any person who is found to have entered in a fashion not sanctioned by these Official Rules and/or who has submitted more than the number of Entries permitted by these Official Rules or found to use multiple accounts to enter the Contest will be deemed ineligible and disqualified. Proof of transmission (screenshots or captures, etc.) does not constitute proof of delivery. Entries generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. The Sponsor will not be responsible for late, falsified, misdirected, garbled or incomplete Entries, which will be void. Entries must be received by 11:59:59 PM EST on July 24, 2017 (the “Contest End Date”) in order to be entered into the judging process (see rule 9). In the event an Entrant posts content contrary to rule 7 below, in the sole discretion of the Sponsor, he or she will be disqualified.
  7. FORMAT AND CONTENT:

    Each Video Entry must:

    1. be in English;
    2. consist of ONLY the Entrant reading the Script in its entirety;
    3. be entered through one (1) of the Methods of Entry listed in rule 5;
    4. be unique;
    5. include the hashtag #tempcaptain when entering through Instagram or Twitter;
    6. comply with Instagram terms of use if entering through Instagram;
    7. comply with Twitter terms of use if entering through Twitter;
    8. be intended for family audience viewing and contain only content that, in the sole and unfettered discretion of the Sponsor, is suitable for all persons, including persons under the age of 13;
    9. not contain any nude, sexually explicit, disparaging, discriminatory, libelous or other inappropriate content of any kind whatsoever;
    10. not contain any content that promotes any product or service other than that of the Sponsor;
    11. not contain any language suggesting or encouraging illegal activity;
    12. not contain anything that infringes or that may infringe anyone’s rights, including intellectual property rights;
    13. not contain any personal information other than the Entrant’s first name;
    14. not prominently feature any identifiable third party products and/or trade-marks, brands, logos or copyright, other than those of the Sponsor.
    15. not contain any copyrighted works (excluding the Script) (other than as owned by the Entrant or the Sponsor) or third party content that may be subject to and protected by intellectual property laws, including but not limited to music, artwork, video and photographs;
    16. not contain any reference to or likeness of identifiable third parties, unless consent has been obtained from all such individuals and such individuals are of the age of majority.

    By submitting a Video, the Entrant grants to the Sponsor the unrestricted right, in the Sponsor’s sole discretion, to use and re-use the Entry in any and all media now known or hereafter devised, in connection with the Contest. . The Entrant accepts that Entries, may, throughout the Contest and thereafter, be distributed, used, reproduced, or displayed by the Sponsor on its Contest Website or Social Media accounts. The Entrant grants to the Sponsor upon entry the right to use the Video as indicated above, without notice or compensation to Entrant and grants the Sponsor an irrevocable waiver of all moral rights protecting the Entry in favor of the Sponsor.

  8. PRIZES: There are three (3) prizes available to be won (each a “Prize”), each Prize consisting of an opportunity for the Winner to appear in an upcoming Hotels.com commercial (the “Commercial”) as a temporary Captain Obvious (Hotels.com “mascot”) between August 14, 2017 and August 17, 2017. The form and media of the Commercial to be selected by the Sponsor in its sole discretion. the Sponsor will cover the talent fees associated with the Prize advertisement including the costs of the Work Permit fee, the session fee, and the Residual fee (collectively referred to as the “Fees”) based on the ACTRA principal performer scale rate for new media. In the event of a television advertisement, both the Session fee and the Residual fee will be upgraded for broadcast use. The actual value of the Prize will depend upon the form of advertisement selected by Sponsor. In the event of only an online advertisement, the approximate value of the Fees will be $1,375.00 (CDN) and in the event of an online advertisement and television Advertisement, the approximate value of the Fees will be $3,575.00 (CDN). Actual value of the Prize will depend upon the use by Sponsor of the commercial and fees payable under ACTRA related thereto. In order to appear in the Commercial, the winner must complete any required forms (including but not limited to a release form) (see rule 10) requested by the Sponsor. The Prize includes return economy airfare for the Winner departing from the Canadian international airport closest to the Winner’s residence to Toronto, ON; three (3) nights’ accommodations in a 4 star hotel in Toronto; $1,000.00 (CDN) in spending money in the form of a cheque made payable to the Winner; and a $1,000.00 (CDN) Hotels.com e-gift card (the “E-Gift Card”). The total approximate retail value of the Prize is between $5,025.00 (CDN) and $7,225.00 (CDN) depending on the form of advertisement. In the event the Prize winner’s closest major Canadian airport is within 100 km of Toronto or if ground transportation is considered the more appropriate way to travel (at the sole discretion of the Sponsor), the Sponsor reserves the right to provide ground transportation in lieu of airfare to/from the winner’s residence to the selected hotel in Toronto, Ontario. The Prize winner will not be compensated for their travel if their closest major Canadian airport is Toronto. Any difference between the approximate retail value and the actual value of the Prize as taken will not be awarded.

    The Prize must be accepted as awarded without substitution and is not transferable, not for resale and has no cash surrender value. The Sponsor reserves the right, in the event that the Prize or any component of the Prize cannot be awarded as described for any reason, to substitute another prize or component of a prize of equal or greater value, without liability. The E-Gift Card is redeemable only at www.hotels.com/gc for prepaid bookings at eligible hotels. The E-Gift Card balance will be reduced by the amount of each purchase. If a purchase exceeds the balance, the difference must be paid with other payment method accepted by Hotels.com. Only one E-Gift Card can be redeemed per online booking. Multiple E-Gift Cards may be combined into one E-Gift Card by contacting customer support at 1-888-999-4468. Gift Cards cannot be used for the following: Bookings paid for at the hotel location or using the Pay Later option online; Bookings made over the phone; Package bookings (i.e. hotel + flight); Bookings made through Group Travel Services; Bookings made prior to receipt of the gift card. You may not use an E-Gift Card to purchase other Gift Cards. In the event the Winner is not available during the determined dates for filming/coordination of the Commercial, he/she will be disqualified and no other compensation will be awarded. There is a limit of one (1) Prize per person during the Contest Period.

  9. JUDGING PROCESS: A panel of judges appointed by the Sponsor will judge all eligible Entries received during the Contest Period on the basis of: (i) personality; (ii) delivery of the Script; and (iii) originality and creativity (collectively, the "Criteria"). All Criteria will be weighed equally. Each Entry will be given a score (the “Score”) by the judges. The Entrants associated with the Entry that received the top three (3) highest Scores will be deemed to be the selected Entrants (each a “Selected Entrant”). Odds of being selected as a Selected Entrant depend on the caliber and number of Entries received during the Contest Period. In the event of a tie between two or more Entries based on the total Score, a random draw will be held between the tied Entries to determine the Selected Entrant. Judging will be completed in Toronto, ON by 5:00:00 PM on July 26, 2017 (the “Judging Process End Date”).
  10. 8. The Sponsor will attempt to contact each Selected Entrant by email or by sending a private/direct message to the Selected Entrant’s Instagram or Twitter account associated with the selected entrant’s Entry (depending on the Selected Entrant’s method of entry) (a “Private Message”) within one (1) business day of the Judging Process End Date. If applicable, the Selected Entrant associated with the selected Instagram or Twitter Account will be asked to reply via Private Message to provide his/her contact information including full name, email address, and telephone number (the “Contact Information”) within 24 hours so that a declaration and release form (the “Release Form”) can be issued and so that a skill testing question can be administered (see below). If a Selected Entrant (a) does not reply via Private Message with his/her contact information within 24 hours (as applicable); (b) fails to correctly answer the skill testing question (see rule 10); or (c) fails to return the properly executed Release Form within the specified time (see rule 10), then he/she will forfeit his/her opportunity to be the Selected Entrant and the Entrant with the next highest Score will be deemed the Selected Entrant and so on until a Prize winner is confirmed or there are no more eligible Entries or by August 3, 2017 whichever comes first.
  11. To be declared a Prize winner, each Selected Entrant must answer correctly, without assistance of any kind, whether mechanical or otherwise, a mathematical skill testing question. Each Selected Entrant will also be required to sign and return within two (2) business days of notification the Release Form, which (among other things): (a) confirms compliance with these Official Rules including eligibility requirements; (b) acknowledges acceptance of the Prize as awarded; (c) releases the Contest Parties and each of their respective agents and associated companies and each of their respective officers, directors, employees, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, the potential Prize winner’s participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; (d) agrees to the publication, reproduction and/or other use of the potential Prize winner’s name, address, voice, statements about the Contest, photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by the Sponsor in any manner whatsoever, including print, broadcast and the internet; (e) confirms that the Winner will be available to carry out the Commercial on the day(s) selected by the Sponsor; and (f) grants the Sponsor a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Commercial in any media formats and through any media channels. Upon accepting the Grand Prize, each Winner irrevocably waives all moral rights protecting the Commercial in favour of the Sponsor. The Commercial may, throughout the Contest and thereafter, be distributed, used, reproduced, exhibited, donated, sold and/or displayed by the Sponsor on its website or social media accounts or otherwise, which rights are granted by the Winner to the Sponsor upon entry, all without notice or compensation to Winner. Winners will need to provide measurements for tailoring of jacket and beard upon returning his/her release Release Form. The Prize will be coordinated with each Prize winner within 1 week of receipt and verification of his/her Release Form (and subject to compliance with all other condition and requirements provided in these Official Rules). CONDITIONS OF ENTRY: By entering the Contest, Entrants (i) confirm compliance with these Official Rules including all eligibility requirements, and (ii) agree to be bound by these Official Rules and by the decisions of the Sponsor, made in its sole discretion, which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Official Rules are subject to disqualification.
  13. GENERAL: The Releasees do not assume any responsibility for (i) the incorrect or inaccurate capture of entry information and entries that fail to comply with these Official Rules; (ii) any loss, damage, or claims caused by an awarded Prize or the Contest itself; or (iii) any failure of the Contest Website, Instagram ,or Twitter, including any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, or technical malfunction of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an Entrant’s or any other person's computer related to or resulting from downloading any material connected to the Contest, all of which may affect a person’s ability to participate in the Contest. Entry material/data that has been tampered with or altered by the Entrant is void.
  14. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of entrants and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein, without regard to conflicts of law principles. Any attempt by an Entrant or any other individual to deliberately damage any website or undermine the legitimate operation of the Contest could be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. This Contest is subject to all applicable federal, provincial, and municipal laws.
  15. In the event of any discrepancy or inconsistency between the terms and conditions of these Official Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to point of sale, print or online advertising, the terms and conditions of these Official Rules shall prevail, govern and control to the fullest extent permitted by law.
  16. The Sponsor reserves the right to terminate or suspend this Contest or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Contest is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, the Sponsor reserves the right to terminate the Contest select the winners according to the judging procedures in rule 9.
  17. CONSENT TO USE PERSONAL INFORMATION: The Sponsor respects your right to privacy. The information you provided will only be used for the purpose of administering this Contest and prize fulfillment.
